Union Pushes Back Over Excessive Punishment

Member wins against a harsh management decision.

The PSA successfully filed an unfair dismissal claim on behalf of a member in the justice system. The member was dismissed from her role in August 2023 following findings that she was not truthful on her job application. The matter also involved a breach of procedural fairness as the Government Sector Employment Rules were not followed. The member had previously raised complaints of racial discrimination against her supervisors.

The matter settled at conciliation and resulted in reinstatement of the member with full back pay. She then commenced training for a similar role.

“Members who believe their dismissal from employment is a disproportionate response to the transgression should contact the Member Support Centre,” said PSA CPSU Legal Services Manager Alison McRobert. “The punishment needs to fit the crime.”
